TERMS AND CONDITIONS FOR GOFLEXNOW

  • INTRODUCTION
    i.

    GOFLEXNOW is an organization that engages in the business of logistics here senders, riders can converge to move goods from one place to another.

    ii.

    These general terms and conditions shall apply to all customers, riders, agents, Shippers, Receivers, partners, service providers (otherwise collectivelyn referred to as “you”, “your” or “yours) and govern all activities.

    iii.

    By engaging our services and downloading the e-application you accept these general terms and conditions in its entirety. If you disagree with these terms and conditions or any part of these general terms and conditions, you may decline from engaging our services.

    iv.

    When you use the Goflexnow App you trust us with your personal data. We’re committed to keeping them confidential.

  • PRIVACY POLICY
    i.

    This policy applies to all users and Partners of Goflexnow services anywhere, including users of the apps, websites, features, or other services. Goflexnow will continue to make changes to this privacy notice as part of our commitment to protecting your privacy and affording you even more transparency.

    ii.

    Personal data is any information relating to an identified or identifiable natural person.

    iii.

    The types or categories of personal data we collect, and process depends on the nature of the relationship with Goflexnow either as a rider or a shipper or a customer in general terms, and the requirements of the applicable law.

    We may collect the following information:

    • Data provided by users to Goflexnow app such as during account creation (Personal Data)
    • Data created during use of our services, such as location, app usage, and device data.
    • Data from other sources, such as Goflexnow partners and third parties that use the Goflexnow Apps.

    • a.

      Data provided by users (This entails information you provide directly to us). We collect personal information you provide directly to us when you use Goflexnow services, including your account information such as name, phone number, email address, bank verification number (BVN) and credit card number when you create a Goflexnow account on the App, your contact information when you communicate with us, and information you may provide to us in connection with surveys, we record call time, duration, and content. We may use the photos submitted by users to verify their identities, such as through facial recognition technologies. We use contact details to notify customers of updates to the Goflexnow app.

    • b.

      Data created during use of our services. This includes location data (riders, shippers, and receivers). We collect precise or approximate location data from riders’ and receivers’ mobile devices. Goflexnow collects this data from the time a delivery is requested until it is finished or delivered, and any time the app is running in the foreground of their mobile device. We use this data to enhance your use of our app, improving pick-up and delivery locations, enabling safety features, and preventing and detecting fraud.

      Automatic Data Collection. We collect data automatically through the use of Goflexnow App services to wit (requesting a delivery and logistics) this may include,

      • Usage data: We collect data about how users interact with our services. This includes data such as access to app dates and times, app features or pages viewed, app crashes and other system activities, type of browser, and third-party sites or services used before interacting with our services. In some cases, we collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers.

      • Transaction information: We collect transaction information related to the use of our services, including the type of services requested or provided, order details, delivery information, date, and time the service was provided, amount charged, distance traveled, and payment method (as acceptable payment method). Additionally, if someone uses your promotion code, we may associate your name with that person.

      • Device data: We may collect data about the devices used to access our services, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data.

    • d.Information from third parties.
      • We collect background check and identity verification information for driver, and delivery persons. This may include information such as driver’s history or criminal record (where permitted by law), and right to work. This information may be collected by an authorized vendor on behalf of Goflexnow.

      • We may collect demographic data about users, including through user surveys. We may also receive demographic data about users from third parties.

      • We collect the information users submit when they contact Goflexnow customer support, provide ratings or compliments for other users or partners, or otherwise contact Goflexnow. This may include feedback surveys, photographs or other recordings collected by users.

      Data from other sources.

      Goflexnow may also obtain information about you from other sources, including publicly or commercially through partners and service provider. This may also include through,

      • User feedbacks, such as ratings, feedback, or compliments.

      • Users participating in our referral programs. For example, when a user refers another person, we receive the referred person’s personal data from that user.

      • Goflexnow account owners who request services for or on behalf of other users, or who enable such users to request or receive services through their accounts.

      • Users or others providing information in connection with claims or disputes.

      • Vendors who help us verify users’ identity, background information, and eligibility to work, for regulatory, safety, and security purposes.

      • Insurance, vehicle, or financial services providers for drivers and/or delivery persons.

  • PURPOSES

    Goflexnow may use, combine, and process your personal data for the following purposes: We process personal information for a variety of business purposes including providing services and features. Goflexnow uses the data we collect to provide, personalize, maintain, and improve our products and services. We also use the data we collect,

    • To enhance the safety and security of our users

    • For customer support

    • For research and development

    • To enable communications between users

    • To send marketing and non-marketing communications to users

    • In connection with legal proceedings.

    How we use personal data. Goflexnow will use your personal information;

    • To provide services on the App (Logistics). This personal information will not be shared with third parties for direct marketing save with the user’s consent but used in connection with your transactions, including,

    • To process payments for services.

    • To verify identity.

    • To approve transactions and monitor online behavior during app usage.

    • Identify potentially fraudulent, prohibited or illegal or illegal transactions.

    • Communicate notifications on your transaction purchases.

    • Create and update users’ accounts.

    • Verify drivers’ and delivery persons’ identity, background history, and eligibility to work.

    • Enable transportation, deliveries, and other services.

    • Offer, process, or facilitate payments for our services.

    • Offer, obtain, provide, or facilitate insurance, vehicle, invoicing, or financing solutions in connection with our services.

    • Track and share the progress of deliveries.

    • a.

      For Administrative Purposes: Goflexnow may use your personal Information for our administrative purposes, including.

      • To respond to your questions, comments and other requests for customer support, technical support or information, including information about potential or future services.

      • To send you SMS on login code.

      • To provide you access to certain areas, functionalities, and features of Goflexnow services.

      • For internal quality control purposes

    • b.

      For legal reasons: Goflexnow may share users’ personal data if we believe it’s required by applicable law, regulation, operating license, or agreement, or where the disclosure is otherwise appropriate due to safety or similar concerns. This includes sharing personal data with law enforcement officials, public health officials, other government authorities, airports (if required by the airport authorities as a condition of operating on airport property), or other third parties as necessary to enforce our Terms.

    • c.

      With Consent: Goflexnow may share a user’s personal data other than as described in this notice, after consent of user is sort and obtained.

  • DATA RETENTION AND DELETION

    Goflexnow retains user data for as long as necessary for the purposes described above. This means that we retain different categories of data for different periods of time depending on the category of user to whom the data relates, the type of data, and the purposes for which we collected the data. Users may request deletion of their accounts at any time. Goflexnow may retain user data after a deletion request due to legal or regulatory requirements or for the reasons stated in this policy. Following an account deletion request, Goflexnow deletes the user’s account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. Because we are subject to legal and regulatory requirements relating to drivers and delivery persons, this generally means that we retain their account and data for a minimum of 4 years after a deletion request. For riders and delivery recipients, their data is generally deleted within 60 days of a deletion request, save where retention is necessary for the above reasons.

  • RETURNS AND REFUNDS
    • i.

      Returns of products after delivery and acceptance of such products shall be managed by Goflexnow. Acceptance and request for refund shall be in our discretion subject to compliance of these terms. We are responsible for your package only while it is within our custody and control.

    • ii.

      We shall not be liable for loss of or damage to a package while it is out of our custody or control, and it is your sole responsibility to maintain any additional insurance that may be required upon delivery by Goflexnow.

    • iii.

      We shall return packages to you in the event that delivery of package is unsuccessful for any reason, the recipient cannot be located or refuses to accept delivery of package or in an event the package for delivery has already been damaged prior to pick up by Goflexnow riders. Where packages are not collected by the shipper/recipient, Goflexnow reserves the right to dispose of these items in any manner they deem fit, sale, charity donations, recycling.

  • RIGHTS
    • i.

      We reserve the right to open and inspect any package to ensure it is capable of storage and transportation within the standard customs procedure in compliance to the law.

    • ii.

      We reserve the right to refuse any packages within our sole discretion.

    • iii.

      We shall not be liable in respect of damages to packages as a result of improper internal or external packaging or labeling.

    • iv.

      We shall not be liable in respect of any loss or damage arising out of any event or events beyond reasonable control of Goflexnow, including regulatory bodies impounding or investigating the packages, as well as force majeure.

    • v.

      We reserve the right to disrupt, alter or discontinue any of our services at any time in our sole discretion without prior notice or explanation and you will not be entitled to a claim of compensation or any other payments at this time.

    • vi.

      Goflexnow will not be responsible for delivery of illicit drugs. Any premeditated crime will result in consumers’ instant removal from the app and legal actions taken.

    • vii.

      We want you to stay in control of your data. Goflexnow provides you with controls through the app where you can view personal information including your profile data and delivery status.

    • viii.

      You can access your personal data via Goflexnow app. You have the right to ask for copies of your personal information.

    • ix.

      We shall not be liable in respect of damages to packages as a result of improper internal or external packaging or labeling.

    • x.

      You have the right to ask us to rectify information you think is otherwise inaccurate.

    • xi.

      You have the right toask us to complete information you think is incomplete.

    • xii.

      You have the right to ask us to erase your personal information in certain circumstances.

    • xiii.

      You have the right to ask us to restrict the processing of your information in certain circumstances. This means that your data can only be used for certain things, such as legal claims or to exercise legal rights.

    • xiv.

      You have the right to ask that we transfer the information you gave us from one organization to another, or give it to you, in certain circumstances. This only applies to information you have given us.

  • NOTICES

    This website is managed and operated by GOFLEXNOW, when necessary; we may contact you using your personal data provided. We also offer in-app settings like marketing opt-ins, and transparent cookie consent controls on our website. Please note that the reinstallation of Goflexnow app on your device does not cause deletion of your personal data. If the Goflexnow app has not been in use for three years, we will get in touch and ask you to confirm whether you wish to keep your account active for further use. If no reply is received within a reasonable time, the account will be closed, and personal data will be deleted unless such data is required for any purpose mentioned earlier in the privacy notice.

  • GOVERNANCE

    These terms and conditions shall be governed by and construed in accordance with the laws of Nigeria. Any disputes relating to these general terms and conditions shall be subject to the exclusive jurisdictions of the Nigerian courts.

  • CLAIMS

    We shall not be liable to you in respect of any loss or damage of package unless you raise a claim for damaged or incomplete delivery within 24 hours of the delivery date. Notwithstanding, no claim for loss or damaged packages shall be entertained until all payments have been made.

  • COPYRIGHT AND TRADEMARK

    Subject to the express provisions of these general terms and conditions, we together with our licensors own and control all the copyright and other intellectual property rights in our website and the material on our website. All the copyright and other intellectual property rights in our website are reserved.

  • DIRECT MARKETING

    We may send direct marketing message to your e-mail address and/or phone number when you have given us permission to do so, or under a soft opt-in basis. If you do not wish to receive direct marketing messages, you may "unsubscribe" from our e-mails, or opt-out on the Goflexnow app.

  • LIABILITY

    Goflexnow liability for loss or damage in respect of any package is limited to the value of the package as declared, or the actual value of the package (ascertained through market price value) whichever cost is the lowest.

  • PAYMENTS

    We receive payments as a direct debit through the Goflexnow App, no cash payments to riders or drivers. All payments are approved upon confirmation of delivery through the App.

  • AUTOMATED DECISION MAKING

    We use help of automated decision-making in case of issuing warnings and implementing delivery service suspension. Using automated decision-making is less error prone, more efficient and safer than using our employees. Delivery suspension will stay in force for 6months, after which access to delivery service will be restored.

  • DISPUTE RESOLUTION

    Dispute relating to the processing of personal data are resolved through customer support ([email protected]) in the first instance. You have the right to contact the Goflexnow Data Protection Officer ([email protected])

  • GOFLEXNOW REWARDS:

    The Goflexnow reward applies with engagement of our services. It is applicable whether you are a new customer, or you send delivery items through Goflexnow every day you can rack up points and access exclusive membership benefits at each level.

    To be eligible to earn this point, you must have engaged our services and check for eligibility status at each level. To do this, you will need to tap on the Goflexnow rewards icon on the app. Kindly review the terms and conditions before accepting.

    ● EARNING REWARDS: Various ways rewards can be earned.

    Earn 3 points per every 5 deliveries on Goflexnow.

    Earn 2 points on categories like electronics, home & living.
